Update as of November 12, 2024:
- The City received a filed appeal of the Planning Commission land use decision to City Council.
Update as of October 31, 2024:
- The Planning Commission on October 24, 2024 approved with conditions.
- The land use "final decision" document is mailed (postmarked) October 31, 2024 and begins the appeal period that ends Tuesday, November 12 at 5:00 p.m. per Woodburn Development Ordinance (WDO) 4.02.01B.1.
Update as of October 15, 2024:
- The window for additional testimony closed September 23. Because of this, the Commission will not take additional testimony at the October 24 meeting and will instead proceed to deliberate. In other words, there will be no public comment period at the meeting.
Update as of September 25, 2024:
- After receiving testimony and taking public comments from the public, the Woodburn Planning Commission on August 22 decided both to close the public hearing of CU 24-02 and to keep the record open for additional written comments from the applicant and the public until Monday, September 23 at 5:00 p.m. All comments should have related to specific applicable Woodburn Development Ordinance (WDO) criteria, such as those mentioned in the August 22 staff report to the Commission.
- The public may view written testimony received after the Planning Commission August 22 public hearing and through September 23, 2024 at the top of the Files section at the bottom of this webpage.
- After September 23, written arguments based on the closed record, but not new evidence, can be submitted to the City until October 7 at 5:00 p.m. (By arguments, what’s meant is writing that seeks to convince or persuade the Commission based on facts in the record, instead of adding new facts to the record.)
- The Commission will receive all testimony and is expected to reconvene on Thursday, October 24, 2024 to deliberate and make its decision on the proposed development.
- The public may view staff reports and testimony at City Hall Monday-Friday 8:00 a.m. to before 5:00 p.m. or online through any of the CU 24-02 City project webpage or the October meeting webpage.

Description: "US Market" gas station with six pump islands and a dozen pumps, convenience store of 4,110 square feet (sq ft), and two office buildings, one 5,000 sq ft and the other 1,863 sq ft and attached to the convenience store. Includes a Street Adjustment application to not upgrade the north nonconforming highway frontage to install a landscape strip with street trees and to not upgrade the east nonconforming Oregon Way frontage to install a landscape strip with street trees.
The proposal was CU 21-02 that the Woodburn Planning Commission approved on June 9, 2022 and that, upon appeal by a competing gas station, the City Council denied on August 8, 2022.
